(PSCM). I, Jared Ebert of the Colorado Division of Reclamation, Mining and <br />Safety (Division) conducted the inspection. Mr. Brian Watterson with Twentymile Coal, LLC. accompanied me <br />during the inspection. It was clear and cold at the time of the inspection. The mine is currently idle and the <br />majority of the roads were not plowed and were not passible. <br />EXPLOSIVES — Rule 4.08 <br />Distance Prohibitions 4.08.4; Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br />The explosives storage area was observed, no problems were noted. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond 003 was snow and ice covered. The embankment and emergency spillway was snow covered. The primary <br />spillway was functioning and the pond was discharging. <br />Pond 002 was snow and ice covered but the pond was discharging. <br />Pond 004 was inaccessible due to the snow conditions. <br />The upper sump was snow and ice covered. The embankment appeared stable and the pond appeared to be <br />discharging. <br />GENERAL MINE PLAN COMPLIANCE: <br />The mine is currently idle and no activity was noted. The portals are sealed and the surrounding area was snow <br />covered but appeared stable. The haul roads to the upper facilities and coal storage area was not plowed and the <br />area was inaccessible. However some of these areas were visible from the main haul road. No problems were <br />noted. <br />
