January 5, 2016 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />John Crowley <br />382 McArthur Dr. <br />Lone Tree, CO 80124 <br />RE: Notice of Intent to Conduct Prospecting Application; LGPD2-2; DRMS File No. P-2015- <br />021; Second Notice of Deficiencies <br />Dear Mr. Crowley, <br />On November 30, 2015, the Division of Reclamation, Mining and Safety (Division) received the <br />Notice of Intent (NOI) to Conduct Prospecting Application for LGPD2-2, File No. P-2015-021. <br />The Application was filed for review on November 30, 2015. Our review indicates the NOI <br />application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules and Regulations <br />of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated Mining <br />Operations. The Division requires the information described below before we can approve the <br />NOI application. <br />1. The NOI application form specifies that no new road construction will be required to access <br />the area where prospecting will occur. The Division has been notified by the USFS that road <br />construction will be required in order to access the site. Pursuant to Rule 5.3.1(c), any new <br />road used for prospecting, or any existing road which is significantly upgraded must be <br />included as part of the affected acreage. A road is significantly upgraded if it is significantly <br />widened, or the route or gradient are significantly altered. Please describe any upgrades <br />which must be made to Forest Service Road 215 and provide the dimensions of any new road <br />which must be constructed between Forest Service Road 215 and the prospecting area. The <br />description shall include the approximate dimensions (length and width) and the approximate <br />gradient. <br />In addition, please describe how the road will be constructed, including provisions for topsoil <br />salvage Finally, provide a brief description of how the road(s) will be reclaimed and confirm <br />that the seed mix used for reclaiming the pits will be used on the road(s), or provide a <br />separate seed mix to be used on the reclaimed roads. <br />Be advised that if these items have not been addressed by February 22, 2016, the Division may <br />terminate the NOI application in accordance with Rule 5.1.3(c) of the Hard Rock Rules. <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br />John W.
