Table 2 reports 1,025 woody stems per acre. Text in Tab G <br />states, "the average woody plant density for the Vento portal reclamation area equals 923.3 <br />woody plants per acre." Although both values exceed the requirement of establishing a minimum <br />of 800 stems per acre, the value needs to be reported consistently. <br />RESPONSE: <br />Text was changed to indicate the correct value of 1,025.1 wood stems per acre, on page 26, in the 2013 <br />vegetation report. The above referenced copies of the revised text show this corrected value. <br />8. A Pond 5 inlet pipe (the southern culvert) needs repair of holes in the metal. <br />RESPONSE: <br />The bottom of the inlet to the southern culvert at Pond 5 has eroded resulting in multiple holes running <br />along the culvert bottom for a distance of 8 to 10 feet. Because of these holes, water flows partially <br />below the culvert until, due to the downward slope, it completely enters into the culvert at the end of <br />the holes. This condition does not impact the flow capacity or function of the culvert. Given that there <br />is no roadway load over this section of the culvert and that there is approximately 2 feet of cover over <br />this section, the holes cause no significant impact to the structural integrity of the culvert. <br />9. Regarding the developed spring in Magpie Diversion, the Division is awaiting laboratory <br />results to determine if the water meets agricultural standards. The results of the laboratory <br />analysis will inform the discussion of whether or not EFCI should reclaim this structure. <br />RESPONSE: <br />EFCI will discuss potential reclamation of the spring structure with the Division upon review of the <br />results of the water sample laboratory analysis. <br />10. There is some trash and debris at the Monarch Fan and at other places on the mine site. Also, <br />there is some trash- at the loadout. The trash should be cleaned up by EFCI. This includes broken <br />pieces of PVC pipe, industrial fabric, bottles, and wood at the mine site and a tire and <br />miscellaneous trash at the loadout. The debris at the South Fan (aka Monarch Fan) includes wire <br />rope, cables, hoses, and rusty cans; it is under discussion whether or not this is the responsibility <br />of EFCI. <br />RESPONSE: <br />This request to pick up trash lacks specificity in terms of exact locations of the trash. The extent of <br />trash removal to meet compliance is also unclear according to this request. EFCI removed trash <br />extensively at the mine site reclaimed areas and at the loadout using machines and by hand. Both the <br />mine site and loadout area were subsequently approved for Phase I bond release without issues related <br />to trash remaining on the reclaimed areas. Subsequent DRMS inspections since at least 2003 have not <br />mentioned excessive trash in reclaimed areas with the exception of trash left by trespassers at the <br />loadout area. Over the years EFCI has removed the polluting trash at the loadout by request of the <br />Division. The historic mining debris at the Monarch Fan were removed by the landowner, and is no <br />longer an issue. <br />
