On May 7, 2014, an adjacent landowner enlarged the pond and dug a diversion trench to an <br />area of possible subsidence above and upgradient of the backfilled and reclaimed portals of the <br />Roadside South Portal Mine. The landowner commenced running approximately 4 cfs of water, <br />diverted from Rapid Creek to the newly constructed trench. Between May 7 and June 11 the <br />majority of this water found its way to the end of the new trench where it then disappeared into <br />the ground (see DRMS inspection report from June 11, 2014 for full details). The water filled the <br />void behind the backfilled portals where it seeped out through the french drain over a period of <br />time. <br />In response to the flow from the reclaimed portals, the DRMS issued an Order to Revise Permit <br />dated October 15, 2015. The Order is included in the findings for bond release SL -08. The <br />Order directed SCC to submit to the Division, within 30 days of the final approval of the SL -08 <br />application, an application for a Minor Revision to the Roadside Mine Permit committing SCC to <br />seven items. With the approval of Minor Revision No. 82 (MR -82), SCC hereby commits to the <br />following items: <br />Snowcap commits to conducting an investigation to determine the extent of the <br />hydrologic communication existing between the underground workings of the Roadside <br />Mine and the properties overlying these workings that belong to Mr. Rudolph Fontanari <br />and Mr. Jason Carey. Snowcap will inform the Division of the dates that the on-site <br />investigation will occur and the Division may attend. On or before April 29, 2016, <br />Snowcap will provide a copy of the final investigation report to the Division. <br />2. Snowcap commits to preparing a plan for the repair of this hydrologic communication. <br />3. Snowcap commits to developing a reclamation plan for any surface disturbances that <br />may occur in conjunction with the implementation of the hydrologic communication <br />repair plan. <br />4. Snowcap commits to develop a cost estimate for the repairs and for the surface <br />disturbances associated with the repairs. <br />5. On or before October 1, 2016, Snowcap commits to submitting a Technical Revision <br />to the Roadside Mine permit requesting approval of the hydrologic communication <br />repair plan, the reclamation plan, and the cost estimate for the repair plan and the <br />reclamation plan. <br />6. Snowcap commits to repairing the hydrologic communication, and to reclaiming surface <br />disturbances that may occur in conjunction with repairing the hydrologic <br />communication. <br />7. Snowcap agrees that the Division will retain reclamation bond dollars associated with <br />approval of Bond Release Application SL -08 until the Permit's bond amount is <br />adjusted during the Division's review of the Technical Revision submitted pursuant to <br />Item 5. <br />MR -82 14-30ii (New. 12/21/15) <br />
