Ebert <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RECEIVED <br />DEC 2 g 2015 <br />Division of Reclamation, <br />Mining & Safety <br />Re: Foidel Creek Mine (Permit No. C-1982-056), 13L Grout Borehole and Access Road, Routt County, <br />Colorado (HC #67400) <br />Dear Mr. Ebert: <br />Thank you for your email correspondence dated and received December 21, 2015 regarding our ongoing <br />consultation for the above referenced undertaking pursuant to Section 106 of the National Historic Preservation <br />Act and its implementing regulations 36 CFR part 800. <br />While we understand that final reporting for this project is pending, we have completed our review of Metcalf <br />Archaeological Consultants, Inc.'s Preliminary Report q% -Negative Finding lorT)Pen�lmile Coal Company J, Proposed t 3L <br />Grout Borehole and_4c ess Road in Routt County, Colorado and find it acceptable. In consideration of the <br />documentation provided, it is our opinion that a finding of no historic properties affected [36 CFR <br />800.4(d)(1)] is appropriate for the proposed undertaking. This determination is based on the negative results <br />of cultural resources within the undertaking's area of potential effects. <br />The Section 106 consultation process does involve other consulting parties such local governments and <br />Tribes which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional <br />information provided by these or other consulting parties may cause our office to re-evaluate our comments <br />and recommendations. <br />Should unidentified archaeological resources be discovered in the course of the project, work must be interrupted <br />until the resources have been evaluated in terms of the National Register of Historic Places eligibility criteria (36 <br />CFR 60.4) in consultation with our office. <br />We thank you for the opportunity to comment and we appreciate the opportunity to develop the alternative <br />identification methodology with you, the contractor, and the proponent that were used for this undertaking.
