12/23/2015 State.co.us Executive Branch Mail -Re: Twentymile Coal, LLC- Foidel Creek Mine -MR 15-291 13 -Left OUtby Utility Borehole Completeness Response
MINIVAIMM
jnettleton@peabodyenergy.com
From: Ebert- DNR, Jared [mailto:jared.ebert@state.co.us]
Sent: Monday, December 21, 2015 4:18 PM
To: Nettleton, Jerry
Cc: Alysha Hernandez - DNR
Subject: Re: Twentymile Coal, LLC - Foidel Creek Mine - MR15-291 13 -Left OUtby Utility Borehole
Completeness Response
Jerry,
have not received the hard copy of your completeness review response with the necessary map, thus I have
not deemed the application complete. However, in order to expedite the process I have reviewed all of the
application material that I have received. Below are items that will need to be addressed prior to approval of
the MR291 application.
1. TC revised permit pages 2.04-9.1 and 9.2 with MR292. MR292 added a new section specifically for
the 13LT Outby Utility Borehole cultural resource survey. The originally proposed revised pages submitted
with MR291 did not take MR292 into account. Page 2.04-9.1 no longer needs to be revised, but page 2.04-9.2
needs to be revised to add a discussion about the results of the cultural resource survey that was conducted
under the new section created for this project with MR292.
2. Proposed revised pages 2.05-45.29 and 2.05-84.13, indicates a maximum of 1.0 feet of soil material
from the road and pad disturbed area will be recovered and stockpiled. Based on Map 17 of the permit, the
new proposed road falls within a portion of soils unit 50E and D10 and the pad area falls within soil unit D10.
The average soil thickness for soils unit D10 and 50E is 30 inches and 18 inches respectively. Given this,
the soils recovery plan does not appear to be adequate. Please revise the soils recovery and storage plan to
salvage all available topsoil. Please revise the above referenced pages accordingly. Also, please update
Table 49A with the revised estimate of topsoil to be salvaged.
3. The first paragraph of proposed revised page 2.05-106.1 does not follow with the paragraph from the
previous page. Please revise these pages for consistency.
Once I get the hard copy of your response, I will deem the application complete. Please let me know if you
have any questions.
hftps://mail.google.com/mail/u/0/?ui=2&ik=e29129fcb5&vi ew=pt&search= i nbox&th=151 cbd922138814f&si m 1=151 cbd922138814f 2/4
