PART I <br />A. PERMITTED FEATURE(S) <br />Appendix 4.7-8 <br />PART I <br />Page 3 of 31 <br />Permit No.: C00048972 <br />Beginning no later than the effective date of this permit and lasting through the expiration date, the permittee is <br />authorized to discharge in accordance with the monitoring requirements of this permit, from the following permitted <br />feature(s): <br />• Outfall 001: Stormwater from reclamation areas <br />Outfall Latitude N Longitude W Receiving Water <br />001 39.562942°N 107.489589°W Colorado River <br />The locations provided above will serve as the points of compliance for this permit and are appropriate as they are <br />located after all treatment, as applicable to the discharge, and prior to discharge to the receiving water. Any <br />discharge to the waters of the State from a point source other than specifically authorized by this permit is prohibited. <br />B. PERMIT COMPLIANCE <br />In accordance with the Colorado Discharge Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, and the <br />federal Effluent Limitation Guideline for the Coal Mining Point Source (40 CFR 434), the permitted discharge shall not <br />contain effluent parameter concentrations which exceed the limitations specified below. All discharges authorized <br />under this permit shall comply with all the terms and conditions required by this permit. Violation of the terms and <br />conditions specified in this permit may be subject to civil and criminal liability pursuant to sections 25-8-601 through <br />612, C.R.S.. Failure to take any required corrective actions, as detailed in the CORRECTIVE ACTIONS section, <br />constitutes an independent, additional violation of this permit and may be subject to civil and criminal liability. <br />C. EFFLUENT LIMITATIONS <br />1. Narrative Water Quality Based Effluent Limitation <br />Discharges authorized under this permit must be controlled as necessary to meet applicable water quality <br />standards. <br />The division expects that compliance with the other terms and conditions in this permit will control discharges as <br />necessary to meet applicable water quality standards. If at any time the permittee becomes aware, or the division <br />determines, that the authorized discharge causes or contributes to an exceedance of applicable water quality <br />standards, the permittee must take corrective action as required, document the corrective actions as required, <br />and report the corrective actions to the Division as required (see CORRECTIVE ACTIONS). <br />If the division becomes aware of information indicating that compliance with the other terms and conditions of this <br />permit will not control the discharge as necessary to meet applicable water quality standards, the division may <br />include additional site-specific water quality -based effluent limitations) to the discharge. <br />2.
