I <br /> PERMIT#:M-1991-123 <br /> I INSPECTOR'S INITIALS:PSH <br /> INSPE1CTION DATE:December 10,2015 <br /> OBSERVATIONS <br /> The Idaho Creek Resource site was inspected by Peter Hays with the Division ofclamation, Mining and <br /> Safety(Division/DRMS) as part of the Division's monitoring inspection program. r. William Kobobel was <br /> notified of the inspection, but was not present during the inspection. The site w4s previously inspected by the <br /> Division on July 31, 2012. <br /> The Division currentlyholds a financial warrantyof 15 610 which is adequate t complete the reclamation$ q p of <br /> the site based on the observations from this inspection. The current reclamatio bond does not account for <br /> the long term exposed groundwater responsibility at the site, since the final aug entation plan has been filed <br /> with the Division of Water Resources. Mr. Kobobel filed an application with the ater court under case no. <br /> 05CW320 for an augmentation plan to replace the depletions resulting from eva oration off the lake. A <br /> proposed decree was filed with the court on May 30, 2012, however the final au mentation plan has not been <br /> approved by the water court. The Division will not approve a full release reques for the site until the final <br /> augmentation plan is approved by the water court. The lake was being drained ily two pumps in the northeast <br /> corner of the site during the inspection. <br /> The site appeared unchanged since the previous inspection. The boat dock in the southwest corner of the lake <br /> and the concrete rubble along the east and north shorelines remain on site as nc(ted in the last inspection <br /> report. The Operator has not submitted an inert fill affidavit for the concrete rubble to date. The Division will <br /> require the Operator to either remove the concrete from the shoreline or submit an affidavit certifying the <br /> material is clean and inert as define by Rule 1.1(20) and required by Rule 3.1.5(9)(c) prior to any future full <br /> release request considerations by the Division. <br /> The vegetation around shoreline and surrounding areas was well established wit only small areas of sparse <br /> vegetation noted during the inspection. Evidence of grazing was observed thro hout the site. A small area <br /> along the southern shoreline has been regraded. The purpose of the regrading i unknown. Overall,the site <br /> was stable and no erosion features were observed during the inspection. Noxio s weeds, Common Mullein <br /> and Scotch Thistle, were observed along the east shoreline during the inspectio .
