MANAGEMENT <br />On behalf of Snowcap Coal Company, Inc. (SCC) enclosed is an application for a <br />technical revision to change the postmining land use at the reclaimed Pond 8 area, <br />containing approximately 0.5 acres. SCC is submitting this application as a "technical" <br />revision because the proposed land use is not subject to the Division's rule 2.05.5(2)(d). <br />The goal of this proposed revision is to change the postmining land use at this area from <br />fish and wildlife to commercial. The revised documents in this submittal are based on <br />the assumption that Technical Revision 67 (TR -67) submitted December 2, 2015, has <br />been approved. <br />All structures and associated facilities at Pond 8 have been removed and final grading <br />and revegetation was completed in October 2011. A portion of the reclaimed area was <br />reseeded in October 2014. Mesa County Department of Planning and Economic <br />Development approved a minor site plan for the use of the lands as a commercial <br />business in June 2006, as shown in Appendix 15-1, and no changes will be required. <br />With the premining land use being commercial, and the majority of the adjacent area <br />having previously been approved for a commercial postmining land use, we believe that <br />incorporating the 0.5 acres for additional parking and material storage for the existing <br />Kokopelli Farm and Produce agricultural business is appropriate. <br />Enclosed are the revised permit documents as follows: <br />Volume 5: Tab 14 - Revised Permit page 14-7; New Appendix pages A14-5-47 and <br />A14-5-48; and Revised Exhibits 6C and 6C -A <br />Volume 5: Tab 15 - Revised Permit page 15-1; New Appendix pages A15-1-8 and <br />A15-1-9; and Revised Exhibit 63 <br />
