From review of vegetation reports in application <br />Technical Revision 45 was approved on July 31, 2015. TR45 provided corrected surveyed <br />acreage values for the reference areas. These values are found on PAP page 2.04.10-5a. The <br />acreage values used in the 2013 and 2014 vegetation reports are not consistent with the value in <br />the PAP. Because reclamation success standards are based on an acreage -weighted approach for <br />both the reference areas and the reclaimed areas, EFCI needs to use the approved acreage as <br />shown in the permit for the reference area calculations. <br />In the 2013 vegetation report, there are two different values reported for the woody plant density <br />on the Vento portal area. Table 2 reports 1,025 woody stems per acre. Text in Tab G states, "the <br />average woody plant density for the Vento portal reclamation area equals 923.3 woody plants per <br />acre." Although both values exceed the requirement of establishing a minimum of 800 stems per <br />acre, the value needs to be reported consistently. <br />From bond release inspection and previous inspections <br />8. A Pond 5 inlet pipe (the southern culvert) needs repair of holes in the metal. <br />9. Regarding the developed spring in Magpie Diversion, the Division is awaiting laboratory results <br />to determine if the water meets agricultural standards. The results of the laboratory analysis will <br />inform the discussion of whether or not EFCI should reclaim this structure. <br />10. There is some trash and debris at the Monarch Fan and at other places on the mine site. Also, <br />there is some trash at the loadout. The trash should be cleaned up by EFCI. This includes broken <br />pieces of PVC pipe, industrial fabric, bottles, and wood at the mine site and a tire and <br />miscellaneous trash at the loadout. The debris at the South Fan (aka Monarch Fan) includes wire <br />rope, cables, hoses, and rusty cans; it is under discussion whether or not this is the responsibility <br />of EFCI. <br />11. The owner of the land surrounding the truck tunnel (Dr. Corley) has raised some issues with this <br />structure: <br />o There are open holes in the concrete. <br />o Part of the roof has been removed and covered with a large piece of metal. <br />o Pipes and any other equipment in the tunnel may contain oil. <br />o The side tunnel is a hazard, and the landowner never wanted it to remain in place. <br />The first two issues were confirmed by DRMS during the inspection. These issues are <br />the subject of a discussion between EFCI and the Division. <br />Other adequacy. items <br />12. Topsoil stockpiles warrant further discussion between EFCI and DRMS; a revision may be <br />needed to keep them as permanent features. <br />If you have questions or need additional information, please contact me. <br />Sincerely, <br />Robert D.
