BOX 1598 <br />FAIRPLAY, CO 80440 <br />Tel: (719) 836-4254 <br />December 9th, 2015 <br />Greg Lewicki, P.E. <br />greg@lewicki.biz <br />Dear Mr. Lewicki, <br />RECEIVED <br />DEC + ‘ 2015 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />Fax: (719) 836-4351 <br />Upon reviewing your application for Mining activity at the Sullivan Aggregate <br />Pit, I have noticed that the four mining areas are all within land designated as <br />Significant Wildlife Habitat according to the County's 1041 Wildlife Regulations. <br />Since mining is not excluded from the regulation's definition of Development, <br />either a Statement of No Impact or a Permit should be obtained before mining <br />commences. <br />Additionally, mining area three is with the Residential zone district and the <br />administrative review cannot be approved unless the area is rezoned to the <br />Mining zone district or the application is modified to exclude the Residentially <br />zoned area. <br />Please also revise the application to address on-site sewage disposal, solid waste <br />management, and any existing or proposed signs. We also need a copy of the <br />operator's CDOT access prtmit. <br />Finally, please be aware that the application includes construction of a road <br />within a Zone A Special Flood Hazard Area.
