The Canon City lease, a copy of which was provided to this office on September 12, 2008, is valid until January 2035. CONDITIONS OF APPROVAL I hereby approve the proposed SWSP in accordance with S37-90-137(11), C.R.S., subject to the following conditions: 1. This SWSP shall be valid for the period of October 1, 2015 through September 30, 2016, unless otherwise revoked, modified, or superseded by decree. If this plan will not be made absolute by a water court action by the plan's expiration date, a renewal request must be submitted to this office with the statutory fee (currently $257) by August 15, 2016. 2. Well permit no. 78822-F was obtained for the current use and exposed pond surface area of the gravel pit in accordance with S37-90-137(2) and (11), C.R.S. 3. The total surface area of the groundwater exposed at the Parkdale Project site must not exceed 4.0 acre during the approval period of this SWSP resulting in an annual evaporative loss of 11.28 acre-feet. 4. The annual amount of water used at the operation shall not exceed 8.8 acre-feet for dust control and the total product mined shall not exceed 540,700 tons (387,500 tons of washed aggregate and 153,200 tons of unwashed material) resulting in 13.66 acre-feet of water lost with the product. 5. Total consumption at the Parkdale Project site must not exceed the aforementioned amounts unless an amendment is made to this plan. 6. Water used for gravel washing ponds that does not infiltrate within 24 hours may require an amendment to the plan to include additional acres of exposed surface area subject to evaporation that will require additional replacement under the plan. Field visits by the Water Commissioner will be made to confirm that 3.4 acres of evaporative surface area is appropriate for settling ponds and the gravel washing pond under this plan. 7. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must first be approved by this office. 8. All pumping for product washing and dust control shall be measured in compliance with the Amended Rules Governing the Measurement of Tributary Ground Water Diversions located in the Arkansas River Basin.
