The Canon City lease, a copy of which was provided to this office on <br /> September 12, 2008, is valid until January 2035. The monthly depletions and replacement <br /> requirements are provided on the attached Table 3. <br /> CONDITIONS OF APPROVAL <br /> I hereby approve the proposed SWSP in accordance with S37-90-137(11), C.R.S., subject to <br /> the following conditions: <br /> 1. This SWSP shall be valid for the period of October 1, 2015 through September 30, 2016, <br /> unless otherwise revoked, modified, or superseded by decree. If this plan will not be <br /> made absolute by a water court action by the plan's expiration date, a renewal request <br /> must be submitted to this office with the statutory fee (currently $257) by August 15, <br /> 2016. <br /> 2. Well permit no. 78822-F was obtained for the current use and exposed pond surface area of <br /> the gravel pit in accordance with S37-90-137(2) and (11), C.R.S. <br /> 3. The total surface area of the groundwater exposed at the Parkdale Project site must not <br /> exceed 4.0 acre during the approval period of this SWSP resulting in an annual evaporative loss <br /> of 11.28 acre-feet. <br /> 4. The annual amount of water used at the operation shall not exceed 8.8 acre-feet for dust <br /> control and the total product mined shall not exceed 540,700 tons (387,500 tons of washed <br /> aggregate and 153,200 tons of unwashed material) resulting in 13.66 acre-feet of water lost <br /> with the product. <br /> 5. Total consumption at the Parkdale Project site must not exceed the aforementioned <br /> amounts unless an amendment is made to this plan. <br /> 6. Water used for gravel washing ponds that does not infiltrate within 24 hours may require an <br /> amendment to the plan to include additional acres of exposed surface area subject to <br /> evaporation that will require additional replacement under the plan. Field visits by the <br /> Water Commissioner will be made to confirm that 3.4 acres of evaporative surface area is <br /> appropriate for settling ponds and the gravel washing pond under this plan. <br /> 7. Approval of this plan is for the purposes as stated herein. Any additional uses of this water <br /> must first be approved by this office. <br /> 8. All pumping for product washing and dust control shall be measured in compliance with the <br /> Amended Rules Governing the Measurement of Tributary Ground Water Diversions located in <br /> the Arkansas River Basin. <br />
