If so <br /> the applicant must submit data regarding the resulting mounding and <br /> shadow effects around the lined ponds and the mitigation measures that it <br /> will take to correct these effects if it will result in impacts to surrounding <br /> land vegetation and structures. <br /> 'A-4 - As presented to the Division on other projects the lining of a pond <br /> has little effect on the local hydrology and water level changes that do <br /> occur are on the order of a foot or less. Unless continuous monitoring is <br /> implemented water level changes at any distance from the pond face are, <br /> for all practical purposes, undetectable.' <br /> The stated reason by OMLR for previous denial of the Technical Revision is that it would <br /> constitute a 'proposed change in post-mining land use,' and hence require an <br /> Amendment to the permit, changing the use from `Industrial/Commercial to Developed <br /> Water Resource.' The correspondence continues stating that, `significant changes in <br /> post-mining land use require public notice per Rule 1.6.' It remains a curiosity to us as <br /> in what manner this holds true? <br /> In the interim, lies before you our Amendment Application, provided in respect of our <br /> differences in this matter in a good faith attempt, in spite of our differences, to cure this <br /> matter according to and consistent with the dictates of the Office. The application is <br /> submitted in good faith that it fully conforms with the spirit and intent of the Act and its <br /> attending regulations respective of the Amendment requirements and process now at <br /> play. It should be understood, while Developed Water Resources is now the 'Primary' <br /> end use, other mixed uses as stated in the Original Application as Approved, remain in <br /> effect. <br /> Thank-you for your understanding and consideration of this submittal.
