Public Health and Safety <br />The proposed uses would not present actual or probable hazard to public health or safety, <br />nor actual or probable threat of water flow diminution or pollution. Residential and <br />recreational development is regulated by the La Plata County Planning Department. <br />Public health and safety issues are therefore addressed within the context of their review <br />and approval of projects. Public health and safety issues for the operation of the <br />industrial and commercial ventures will be regulated by MSHA (mining) and OSHA <br />(other commercial ventures). For the existing land uses as described above, the required <br />development, operation, and reclamation permits have been or will be secured. <br />Reclamation Delays <br />As these land uses have already been implemented, there would be no delay in <br />reclamation of the mine site attributable to implementation of the post -mining land uses. <br />Fish and Wildlife Values <br />This rule pertains to alternative land use changes proposed during a permit application <br />process and prior to surface coal mining operations. In any event, there are no adverse <br />impacts to fish, wildlife or related environmental values by approving the proposed land <br />use changes. <br />Land Use Changes to Cropland <br />This rule does not apply, as the alternative post -mining land use being requested is not <br />cropland. <br />2.05.6 Mitigation of the Impacts of Mining Operations <br />2.05.6(1) Air Pollution Control Plan <br />Fugitive dust and any other particulate matter passing into the air were mitigated as <br />follows: <br />All roads will be sprinkled with water during the hours of operation. <br />• All areas where the vegetal material has been removed to facilitate the operations, <br />were sprinkled with water during periods when vehicles are passing through and/or the <br />areas were seeded to grasses, or they may be hard surfaced. <br />• All coal waste was handled according to the Section 4. 10, Coal Processing Waste, <br />and placed back in the pit as part of the backfill material.
