Fish and Wildlife Values <br />This rule pertains to alternative land use changes proposed during a permit application <br />process and prior to surface coal mining operations. In any event, there are no adverse <br />impacts to fish, wildlife or related environmental values by approving the proposed land <br />use changes. <br />Land Use Changes to Cropland <br />This rule does not apply, as the alternative post-mining land use being requested is not <br />cropland. <br />2.05.6 Mitigation of the Impacts of Mining Operations <br />2.05.6(1) Air Pollution Control Plan <br />Fugitive dust and any other particulate matter passing into the airweremitigated as <br />follows: <br />All roads will be sprinkled with water during the hours of operation. <br />All areas where the vegetal material has been removed to facilitate the operations, <br />weresprinkled with water during periods when vehicles are passing through and/or the <br />areas wereseeded to grasses, or they may be hard surfaced. <br />All coal waste washandled according to the Section 4.10, Coal Processing Waste, <br />and placed back in the pit as part of the backfill material. Also, the coal fines will be <br />temporarily placed in a pit which will also provide protection from the wind. <br />There is no longer anycoal processing equipmenton site <br />2.05.6(2) Fish and Wildlife Plan <br />The post mining land use of the permit area is industrial and commercial, residential, and <br />recreation. Through the reclamation and revegetation plan OEI intends to provide a <br />buffer between the more active andpassive land uses which accommodates wildlife. <br />This will be achieved through backfilling and grading to establish topographic buffers, <br />plantings, and revegetation. <br />Disturbance of wildlife will occur during the mining/reclamation activities. However, the <br />disturbance will be mitigated to the extent possible by minimizing the removal of existing <br />vegetation. All fences, roads, powerlines, facilities and structures required to carry on the <br />mining/reclamation operations will be designed and constructed to prevent the <br />entrapment of, or injury to, the wildlife species.
