Daniels - LeCompte- Wagner Well No. 2. <br /> Location of well: In the NEi of the S:;a of Sec. <br /> 3, T. 15S., R. 66W., being at a point on the South <br /> line thereof 1015 feet pest of the East line of <br /> said Quarter Section and North 14 degs. 57' West <br /> of said point a distance of 371 feet. <br /> C. Daniels- LeCompte- Wagner Well No. 3. <br /> Location of well: In the NE4 of the SEa of <br /> Section 3, T. 15S., R. 66W, at a point 910.6 feet <br /> West of the East line of said Quarter Section, <br /> and 75 feet North of the South line thereof. <br /> All of the above Decreed in this court in case No. W559. <br /> 2. That the Applicant seeks approval of a Plan of Augmentation <br /> wherein the applicant will replace depletions to the Fountain River System which <br /> will result from all of its pumping of said wells whose Decrees are junior, and the <br /> use of water therefrom in its gravel production and Transit Mix Conercte <br /> operations. <br /> 3. That the Applicant has acquired or will acquire before this Decree <br /> becomes effective or allows pumping of said wells, 104 shares of Fountain Mutual <br /> Irrigation stock giving it an entitlement to the production of water represented by <br /> said shares for uses in this Augmentation Plan. To assure that no injury results to <br /> the Fountain Mutual Ditch Company deliveries to the Applicant will be reduced by <br /> 5%. This water will be left in the Ditch for the benefit of other water uses under <br /> the Ditch. The water produced by said shares will not be used for the irrigation of <br /> any lands previously irrigated and that portion delivered to the Applicant will be <br /> released to the fulfillment of the requirements of this Augmentation Plan at one of <br /> the following locations to replenish the stream's depletions and the aquifer. <br /> A. At a structure to be constructed in the Fountain Mutual <br /> Ditch at a location in the NE4 of Sec 3 Township 15S Range 66W of the 6th P.M. <br /> on the Applicant's property where the water will be discharged into a pond located <br /> on the Applicant's property near the location of said wells and allowed to seep and <br /> return to the aquifer and the river as replacements for the net depletions caused by <br /> -2- <br />
