including, but not limited to, all laws, regulations, permits, bonds, orders and <br /> required governmental consents pertaining to mining operations, mined land <br /> reclamation, local land use regulation, and environmental regulation and control. <br /> Lessee shall be deemed to be in compliance with governmental regulations and <br /> orders while Lessee is contesting any alleged or cited noncompliance in good <br /> faith in circumstances in which the Property and Lessor's interest are not <br /> jeopardized. <br /> (c) The payment set forth above shall be deemed full payment to Lessor for any <br /> damages to the surface of the Property or the Leased Strata which may be caused <br /> by Lessee's operations hereunder, if and so long as Lessee conducts its operations <br /> in a reasonable and prudent manner and in compliance with this Lease and all <br /> applicable governing agencies. <br /> (d) Lessor shall take no action, directly or indirectly, which would cause or encourage <br /> the loss of restriction of Lessee's right under applicable governmental regulations <br /> to mine and remove Minerals from the Property in the maximum quantity <br /> available from the Property, provided that this subparagraph shall not limit <br /> Lessor's right to terminate this Lease for default. <br /> (e) Lessee shall permit Lessor to review copies of all received licenses and permits <br /> allowing the mining operation conducted pursuant to this lease, and shall permit <br /> Lessor to make copies of any such license or permit at Lessor's sole expense. <br /> (f) Lessee shall provide Lessor a copy of any allegation made against Lessee <br /> regarding the mining operation conducted pursuant to this lease, and a copy of <br /> any allegation made against Lessee that it has violated the terms of any license or <br /> permits held by Lessee for mining operations in El Paso County. <br /> 16. Taxes and Encumbrances. <br /> (a) Lessee shall be responsible for and pay when due any mineral production tax and <br /> any tax assessed against the personal property, improvements or fixtures <br /> hereafter placed on the Property by Lessee and any increase in real property <br /> taxes that directly result from improvements or change to the Property at the <br /> instance of Lessee's operations thereon pursuant to the terms of this Lease. <br /> Lessor is a Title 32 Special District which is a political subdivision of the State <br /> of Colorado. The Leased Property, prior to the execution of this Lease is used <br /> for exempt purposes and is exempt from real property tax assessment rolls of El <br /> Paso County, Colorado. Lessee shall be responsible for any and all property and <br /> other taxes assessed against the Property, which accrue during the term of this <br /> Lease. <br /> 9 <br />
