Substitute Water Supply Plan and Gravel Well Permit Application <br /> Lafarge currently has as approved Substitute Water Supply Plan (SWSP) for the adjacent 35`h <br /> Avenue Pit. Lafarge will submit a renewal for the 35`h Avenue Pit SWSP to the State Engineer's <br /> Office (SEO) by September 15, 2009 and include the consumptive use from the Lafarge Brown <br /> Mine in the renewal. The depletions and augmentation schedule will be outlined in the SWSP. <br /> Lafarge owns water rights in this reach of the Cache La Poudre River which could augment the <br /> depletions at the Lafarge Brown Mine throughout the mining life of the property. <br /> Lafarge has a perpetual lease from the City of Greeley in exchange for 125 acre-feet of year-round <br /> augmentation water, which will be the primary augmentation source for this site. Lafarge owns 8.5 <br /> Box Elder Ditch shares which can be used for augmentation of depletions at the Lafarge Brown <br /> Mine. The Box Elder Ditch shares have historic consumptive use credits of 426.3 acre-feet per <br /> year. The Box Elder Ditch shares are currently used at a recharge site and are able to provide <br /> augmentation during the winter months at the Lafarge Brown Mine. <br /> These water rights are currently used to augment other active mining sites,but could also be used in <br /> the future to augment the Lafarge Brown Mine. Lafarge's water right portfolio in this reach of the <br /> Poudre River can augment the Lafarge Brown Mine during mining and after reclamation. <br /> The policy of the SEO is to provide a copy of the SWSP approval to the DRMS for the site when <br /> the review process is complete. Lafarge will also complete the required 600 foot well inspection <br /> with the water commissioner and submit the required gravel pit well permit application to the SEO. <br /> Lafarge will not expose groundwater at the Lafarge Brown Mine until both the SWSP and well <br /> permit are approved by the SEO. <br /> Long-term Augmentation <br /> A water court application for a long-term plan for augmentation will be filed three years prior to the <br /> completion of mining.
