Due to an <br />underground spontaneous combustion event the mine is currently idled and not operating. <br />Whether the mine reopens is dependent on uncertain economic conditions in the coal market. <br />Oxbow has a number of 404 permits for the operation. Permit SPK -2008-1035 CW is for our Bear <br />Creek fansite. Permit file 199975232 is for our Elk Creek Mine main surface facilities area. <br />Oxbow is evaluating our post -mining reclamation requirements with respect to our Colorado <br />Division of Minerals and Geology Permit. We are evaluating a few "what if" reclamation <br />scenarios and considering changing our reclamation plans. <br />1 <br />
