RE: Wagner Pit Permit No_ M-2010-002, Corrective Action 90 -Day Extension Request Approval
<br />Dear Mr. Wagner:
<br />The Division of Reclamation Mining and Safety (Division) inspected the above me„tip„ed aite o„
<br />September 9, 2015. Availability of records was cited as problem. Corrective actions require the
<br />operato, to demonstrate that the operation is in compliance with the Ottice or State hngineer (OSE).
<br />This could be achieved by providing the Division with a valid g, avel pit well permit that meet the
<br />approved reclamation plan requirements. The corrective action due date was November 17. 2015.
<br />In efforts to abate the inspection problem Mr. wager was made aware that the original permit
<br />application sent to the OSE on January 30, 2008 was neve filled o, , eco, ded. M'. Wagner has since
<br />reapplied tor the original permit. On November 12, 2015 a formal request for a 90 day extension
<br />Was received from Jay Wagner. -the Division reels this is an appropriate amount of time to obtain a
<br />valid well permit and is the, efc, a app, oving the 90 -day extension request.
<br />"1'o avoid potential future enforcement actio„ fin „o„ -compliance with State Statutes, Rules and
<br />Regulations, and/or conditions specified in your permit for this site, you must submit compliance
<br />documentation with the corrective actions specitied by Wednesday, February 10, 2016.
