Haul Road, the permittee shall submit a technical revision to the permit which provides a <br />reclamation plan, sampling methodologies and reclamation success requirements for the <br />cropland areas in accordance with Rule 2.05.4(2)(e), Rule 4.15.1(2)(c), Rule 4.15.9 and <br />Rule 4.15.7(2). The technical revision needs to be approved prior to initiation of <br />reclamation activities associated with the Tie -Across Haul Road cropland areas. <br />SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />There are no specific variances and approvals by the Division for the Hayden Gulch Loadout. <br />SECTION VI — BONDING SUMMARY <br />As of November 20, 2015, the Division estimates liability at the Hayden Gulch Loadout is <br />$1,193,444.18. This amount is sufficient to assure completion of the remaining reclamation <br />work at the site if the work had to be performed by the Division, including the cost of re- <br />establishing vegetation on any revegetated areas, should those areas fail. The permittee currently <br />has on deposit with the Division two Travelers Casualty and Surety Company of America bonds <br />in the amount of $1,203,940.32. Both bonds are corporate sureties. Due to updated costs to the <br />Division's cost data conducted during this midterm review, the liability of $1,193,444.18 is <br />$51,240.84 higher than the cost estimate completed since the last Renewal (RN -04). HGTI <br />currently has adequate bond in excess of $10,496.14 over the updated reclamation costs for MT - <br />05. <br />SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />Pursuant to 2.08.3, the Division finds that the permit application C-1992-081 contains three <br />items that require updates or corrections for the purpose of fulfilling the requirements of the <br />Colorado Surface Coal Mining Reclamation Act, and the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining. The Division requests that the permittee correct the <br />deficiencies by submission of revised permit pages under appropriate revision applications by <br />January 29, 2016. <br />Item 1: In accordance with Rule 2.03.3(1), Tab 1 of the permit should be updated to reflect the <br />current and future status of the loadout. Although the rail line currently remains, all loading, or <br />unloading facilities and equipment have been removed from the site, and the facilities area <br />reclaimed. <br />Item 2: In accordance with Rule 2.03.3(1) please provide updated information found in Tab 3: <br />a) Please update to applicable contact information. This section still contains a contact <br />address of: 37796 RCR No. 53, and phone number (970) 276-7003. The Division has <br />been informed that this information has changed. Please assure that the information <br />in the permit is up to date. <br />b) Is the information for the "resident Agent still current? Please update this information <br />if necessary. <br />c) Please assure that Ownership and Control information is up-to-date. <br />Hayden Gulch Loadout 4- 10/26/2010 <br />
