(Elam) under Mine Permit
M-2000-078. The Colorado Division of Reclamation, Mining and Safety (DRMS) Minerals Program conducted
an inspection at the pit on September 9, 2015. The Inspection Report documenting observations recorded
during the inspection identified problems or possible violations regarding potential compliance with Colorado
Division of Water Resources (DWR) requirements. Specifically the inspection report stated that there is no
evidence of a valid well permit, substitute water supply plan, or approved water augmentation plan for the
exposed groundwater at the pit.
Elam reviewed the online well permit file for the well permit (Permit No. 69433F) issued for the Gehrman Pit.
Elam contacted DWR to confirm the status of the well permit because it was not clear from the available online
information whether supplemental information for the pit well had been submitted to DWR as required the
Conditions of Approval specified in the permit. DWR was not able to find a record of the information and
suggested the information be submitted now to complete the file and ensure the well permit remains valid. Elam
submitted the supplemental information to DWR on November 4, 2015.
The Gehrman Pit is located along a reach of the Yampa that is not considered to be over -appropriated with
respect to water rights. As a result, augmentation through an approved substitute water supply plan or decreed
plan for augmentation is not required for the issuance of a well permit or a water right.
If you have any questions or need additional information, please contact me at (970) 242-5370 or
Jon.Mueller(aelamconstruction.com.
Sincerel
Jonlueller
Environmental Compliance Coordinator
Elam Construction, Inc.
ns
