BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE 112c PERMIT APPLICATION OF JRS MINING, LLC, <br />File No. M-2015-017 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />October 28, 2015 for a hearing to consider the application of JRS Mining, LLC <br />("Applicant") for a 112c reclamation permit, file number M-2015-017. Michael <br />Cunningham and First Assistant Attorney General Jeff Fugate appeared on behalf <br />of the Division of Reclamation, Mining and Safety ("Division"). There were no <br />appearances on behalf of either Applicant or the only remaining objecting parties, <br />John and Eileen Schmidt. <br />The Board, having considered the Division's presentation and being <br />otherwise fully informed of the facts in the matter, enters the following: <br />FINDINGS OF FACT <br />1. On April 13, 2015, Applicant filed an application with the Division for <br />a 112c reclamation permit for a site known as the Sullivan Aggregate Pit in Park <br />County, Colorado ("Application"). Located in Section 32, Township 9 South, Range <br />77 West, 6th Principal Meridian, the Sullivan Aggregate Pit is a proposed gold and <br />sand and gravel mine and on-site processing operation. <br />2. The Application describes placer gold mining in which mined material <br />will be run through a wash plant with a hopper, trommel screen, and a sluice. <br />Placer gold is the primary commodity to be produced from the Sullivan Aggregate <br />Pit; sand and gravel will be sold as secondary commodities. The permit boundary <br />described in the Application encompasses 42.68 acres, of which the Applicant <br />anticipates to affect a maximum of 2.86 acres. The Division calculated the required <br />bond amount for the site to be $20,767.00. The Application proposes to reclaim the <br />affected lands for residential and wildlife habitat post -mining use. <br />3. Applicant completed public notice of the Application in accordance with the <br />requirements of the Mined Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act") <br />and the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board <br />for Hard Rock, Metal, and Designated Mining Operations ("Rules"). <br />4. The period for public comment on the Application closed on August 14, <br />2015. During the public comment period, the Division received letters of objection <br />from Ann Lukacs, Carolyn Erdle, Adam Guthrie, and John and Eileen Schmidt <br />
