4. On January 26, 2015, the Division met with Prospector to discuss <br />details of the Application and the Modification MD -03. <br />5. The Division mailed Prospector a written notice of deficiencies in the <br />Application on January 29, 2015. <br />6. On March 31, 2015 and again April 30, 2015, the Division approved <br />Prospector's requests for extensions of the decision deadline. <br />7. On May 1, 2015, the Division received Prospector's responses to the <br />Division's first notice of deficiencies to the Application. The Division deemed <br />Prospector's responses to the first notice of deficiencies to be adequate. <br />8. On May 12, 2015, the Division mailed Prospector a second written <br />notice of deficiencies in the Application. <br />9. The Division received Prospector's responses to the Division's second <br />notice of deficiencies on July 8, 2015. The Division deemed Prospector's responses <br />to the second notice of deficiencies to be adequate. <br />10. On July 27, 2015, the Division issued a written Notice of Decision to <br />approve Modification MD -03. <br />11. On August 3, 2015, the Division received timely requests to appeal the <br />Division's decision to approve the Application and Modification MD -03 from Kay <br />Hawklee; Lee Alter, Chairman of the TAC Government Affairs Committee; and <br />Jennifer Thurston on behalf of INFORM. <br />12. As proposed and approved by the Division, the Application details <br />Prospector's use of underground borehole mining technology ("UBHM") to collect <br />one two hundred (200) ton bulk sample of ore from the Echo Park formation <br />through one borehole. The Application provides for the collected ore to be <br />transported offsite for additional processing. <br />13. Underground borehole mining technology entails, as proposed in <br />Modification MD -03, lowering a water jet past overlying geologic strata through a <br />cement seal and casing to the Echo Park formation. The water jet is intended to <br />remove ore slurry from the Echo Park formation and transport it through the seal <br />and casing to the surface. <br />14. Testimony and evidence presented at the hearing shows that Applicant <br />has conducted extensive historic exploration of the Hansen Uranium Project and <br />knows, through drilling core holes and feasibility studies, that commercial <br />quantities of uranium exists in the ore body to be sampled by the UBHM process. <br />Black Range Minerals, LLC <br />Hansen Uranium Project/P-2009-025 2 <br />
