• discharge from Sedimentation Pond L-1 and this pond has never discharged <br />since its initial construction in 1981. EFCI has therefore concluded and <br />the CMLRD has concurred, that flow monitoring in Chandler Creek would be <br />of little value and is not necessary. <br />Surface Water Use <br />Surface water use within the drainage basin is generally limited to large <br />volume municipal use or small to moderate volume irrigation use. <br />Diversions for beneficial surface water use exist on Newlin, Hardscrabble, <br />Oak, and Chandler Creek and the Arkansas River. The only existing <br />diversion in the mine, loadout, or adjacent areas is the diversion for the <br />City of Florence on Newlin Creek previously described in this section. <br />Other surface water rights within the drainage basin are summarized by <br />Table 15, Surface Water Rights - Mine and Loadout Area. This listing <br />• includes both upstream and downstream water rights on potentially effected <br />drainages. It should be noted that the mine disturbance area is <br />effectively hydrologically isolated from downstream drainages due to <br />prevailing dry streambead conditions and ephemeral flow conditions in <br />lower Newlin Creek. As a result, downstream water users do not issue <br />calls on upstream junior water rights since transfer of water is not <br />feasible. <br />Surface Water Oualitv <br />As previously noted, there are significant differences in surface water <br />quality for upland and lowland portions of area drainages as well as for <br />perennial and ephemeral streams. Generally, upland drainages originating <br />in the heavily forested mountainous areas to the west have demonstrated <br />relatively low TSS levels due to limited erosion in forested areas, well <br />armored rocky stream channels, and elevated flow volumes consistent with <br />large contributing drainage areas and perennial flow characteristics. <br />• Transitional and lowland drainages, on the other hand, commonly have <br />relatively high levels of TSS and variable levels of TDS.
