<br /> <br /> <br /> <br /> <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br /> <br />November 17, 2015 <br /> <br />Notice to Parties and Interested Persons <br /> <br />RE: Approval of Conversion Application (CN-01); Dollerschell Pit; Permit No. M-1986-074 <br /> <br />Dear Party and/or Interested Person, <br /> <br />The Division of Reclamation, Mining and Safety (Division) appreciates you taking time to participate in <br />the review process of the Conversion Application for the Dollerschell Pit, DRMS File No. M-1986-074. <br />On November 5, 2015, the Pre-hearing Conference was held in Sterling, CO and Bruce Stover (Pre- <br />hearing Conference officer), John Roberts (Mined Land Reclamation Board attorney), Wally Erickson <br />(representing the Division), Elliott Russell (representing the Division), Kym Schure (Operator), Greg <br />Yocom (Objector), and Thomas Bledsoe (Objector) attended. During the Pre-hearing Conference, Mr. <br />Yocom and Mr. Bledsoe submitted the enclosed Party Status Withdraw Forms. The third objectors, Darrell <br />and Shirley Smith, were not present during the Pre-hearing Conference and thus forfeits their party status <br />and all associated rights and privileges per Rule 2.7.3(4). <br /> <br />Pursuant to Rule 2.7.3(5), when all objections are withdrawn the Mined Land Reclamation Board (Board) <br />directs the Division to act on behalf of the Board and to timely approve the application. Therefore, on <br />November 5, 2015, the Division approved CN-01. The Formal Board Hearing scheduled for November <br />18, 2015, has been canceled.
