Name Change to Natural Soda, LLC, a Delaware Limited <br />Liability Company <br />Nahcolite Project, Permit No. M-1983-194 <br />Rock School Lease Experimental Nahcolite Mine—Permit No. M-1999-051 <br />Dear Ms. Coria: <br />I am writing to you with respect to the change of name of Natural Soda, Inc. to Natural <br />Soda, LLC. In particular, I am writing with respect to the provisions of Hard Rock, Metal, And <br />Designated Mining Operations Rule 6.3.12, which provides, in part, that the "Applicant shall <br />provide information sufficient to demonstrate that the stability of any structures located within <br />two hundred (200) feet of the operation or affected land will not be adversely affected." <br />I and Agapito Associates, Inc. (AAI) have provided consulting services for Natural Soda <br />since 1988 in various capacities including review of mine plans, prediction of subsidence, review <br />of cavern shapes and monitoring of subsurface movement above the caverns. We have assisted in <br />drilling some of the early exploration and horizontal wells and have monitored annual production <br />from the caverns over the past 20 years. We have assisted Natural Soda with permit revisions in <br />1995 and 2003—leading to the introduction of submersible pumps—and with monitoring the <br />movement of the rock above the caverns. <br />I have Bachelor of Engineering in Civil Engineering from the University Of Adelaide, <br />Australia and a Ph.D. from the University of Minnesota in GeoEngineering. I have been elected a <br />as a Fellow of the American Rock Mechanics Association (ARMA). I am a Registered Member <br />of the Society of Mining Engineers (SME) and have been a member of SME since 1970. I am also <br />a Registered Professional Engineer in Colorado and Texas. I have practiced consulting to the <br />mining industry since 1974 with over 38 years of service in Colorado.
