As with the request to limit the <br />vertical section of WPX's wellbores, WPX is open to discussing with NSI and NSHI the best ways to <br />accommodate all of our respective future operations in this area. <br />In the meantime, pending further discussion of these issues and as a courtesy to NSI/NSHI, WPX <br />has agreed to provide NSI/NSHI with certain data that pertain to the mutually held areas of operation, <br />such as directional surveys and plats of any planned locations, and WPX will continue to provide this <br />information going forward. Likewise, it will be helpful to WPX for NSI to share pertinent information <br />regarding planned mining operations. WPX has previously provided NSI/NSHI with surface open hole <br />logs for the RGU 424-25-198 well and would be amenable to discussing future trading of data between <br />our companies as practical and necessary. <br />WPX looks forward to continuing open communication with NSI/NSHI in Rio Blanco County. <br />We hope NSI/NSHI will join us in this cooperative spirit.
