PERMIT #: M-1991-035
INSPECTOR'S INITIALS: MAC
INSPECTION DATE: October 26, 2015
The following observations were made for the affected area in phases 1-3:
Hydrologic Balance:
The Division observed water in a small pond in phase 1, the pond has been referred to as the "kettle pond" in
previous permit documents. The Division had previously observed water in this pond during an inspection
conducted in February 2013. Correspondence from the Office of the State Engineer dated August 27, 2013
indicated that the pond was backfilled to two feet above the groundwater level. The Division observed
hydrophytic vegetation in the standing water, which indicates the source of water is from groundwater rather
than stormwater runoff. The Division does not have a record of a well permit or substitute water supply plan
to cover evaporative depletions associated with the exposed groundwater. The presence of the exposed
groundwater has been cited as a problem and will require corrective action by the Operator; please see the
first page of this report for additional detail.
Financial Warranty:
The Division holds a financial warranty in the amount of $423,800.00, which has been determined to be
adequate to complete reclamation.
This concluded the inspection.
