PERMIT #: M-1991-035 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: October 26, 2015 <br />The following observations were made for the affected area in phases 1-3: <br />Hydrologic Balance: <br />The Division observed water in a small pond in phase 1, the pond has been referred to as the "kettle pond" in <br />previous permit documents. The Division had previously observed water in this pond during an inspection <br />conducted in February 2013. Correspondence from the Office of the State Engineer dated August 27, 2013 <br />indicated that the pond was backfilled to two feet above the groundwater level. The Division observed <br />hydrophytic vegetation in the standing water, which indicates the source of water is from groundwater rather <br />than stormwater runoff. The Division does not have a record of a well permit or substitute water supply plan <br />to cover evaporative depletions associated with the exposed groundwater. The presence of the exposed <br />groundwater has been cited as a problem and will require corrective action by the Operator; please see the <br />first page of this report for additional detail. <br />Financial Warranty: <br />The Division holds a financial warranty in the amount of $423,800.00, which has been determined to be <br />adequate to complete reclamation. <br />This concluded the inspection. <br />Page 3 of 5 <br />
