Our clients consider icing Coal a neighbor, and want to extend them
every courtesy as such. Crosscreek Ranch also hopes to be treated as a neighbor in
return.
During a recent review of the GCC King Coal Mine permit file, we have noted that the
Division of Reclamation, Mining and Safety (the "Division") made some determinations
that we find very troubling. We here request that this matter be reviewed and
appropriate corrective action be taken.
We start with some background.
Background
I. First, the mine has been operating without any local land use permit.
The company has been operating without the required local land use permit. La Plata
County, in the attached letter of August 5, 2010,. called this to the company's attention.
Yet in the succeeding five and a half years, the company has still not obtained a permit.
There is thus no effective regulation at any level of government of the intense and
growing truck traffic that poses very serious safety, health and environmental risks to
residents on this small, narrow substandard dirt road.
