Our clients consider icing Coal a neighbor, and want to extend them <br />every courtesy as such. Crosscreek Ranch also hopes to be treated as a neighbor in <br />return. <br />During a recent review of the GCC King Coal Mine permit file, we have noted that the <br />Division of Reclamation, Mining and Safety (the "Division") made some determinations <br />that we find very troubling. We here request that this matter be reviewed and <br />appropriate corrective action be taken. <br />We start with some background. <br />Background <br />I. First, the mine has been operating without any local land use permit. <br />The company has been operating without the required local land use permit. La Plata <br />County, in the attached letter of August 5, 2010,. called this to the company's attention. <br />Yet in the succeeding five and a half years, the company has still not obtained a permit. <br />There is thus no effective regulation at any level of government of the intense and <br />growing truck traffic that poses very serious safety, health and environmental risks to <br />residents on this small, narrow substandard dirt road. <br />
