EXHIBIT D-Mining Plan(Rule 6.4.4): <br /> 5.In accordance with Rule 6.4.4(g)(ii), please state the nature of the stratum immediately beneath the <br /> material to be mined. <br /> The stratum immediately beneath the material to be mined is a hard clay. <br /> 6.Please clarify if topsoil will be stripped in areas where stockpiles (non-topsoil) will be located outside <br /> of the creek channel. <br /> We do not intend to strip topsoil for areas outside the creek where we stockpile mined material. <br /> The topsoil would be left in place,prepared for seeding,and seeded when reclamation occurs. <br /> EXHIBIT J - Vegetation Information (Rule 6.4.10): <br /> 7.In accordance with Rule 6.4.10(1)(a),please provide quantitative estimates of cover and height for the <br /> vegetation described in Exhibit J of the application. <br /> The primary area to be mined is in Frenchman Creek. Vegetation is the creek is periodically wiped <br /> out when we have heavy rains. Current vegetation includes some cottonwood and Chinese elm <br /> trees 20' to 30' feet in height. Other vegetation includes broadleaf weeds and western wheatgrass <br /> and blue gramma grass. Cover is estimated to be 30%. Height of the broadleafs and native grasses <br /> range from 12"to 18". <br /> EXHIBIT R—Proof of Filing with County Clerk and Recorder(Rule 6.4.18): <br /> 8.Please note that any changes or additions to the application on file in our office must also be reflected <br /> in the public review copy, which was placed with the Phillips County Clerk and Recorder by the <br /> Operator. Submit proof that the public review copy has been updated with a copy of the response to this <br /> adequacy letter. <br /> Proof of filing with the County Clerk is attached. <br /> This concludes our responses to your adequacy letter.
