The Operator may not commence mining and milling activities until <br /> the Division receives and approves, through the Technical Revision or Amendment <br /> process as determined by the Division, mining and reclamation plans, with <br /> associated work plans, which satisfy the requirements of Rules 6.4.4, 6.4.5, 6.4.6, <br /> and 6.5. <br /> 6. The Operator may not commence mining and milling activities until the <br /> Division receives and approves, through the Technical Revision or Amendment <br /> process as determined by the Division, design specifications certified by a licensed <br /> professional engineer for all Environmental Protection Facilities, as required by the <br /> Act and Rules, and the Operator satisfies the specific requirements of Rules 7.3 and <br /> 7.4. The Environmental Protection Facilities include, but are not limited to, the <br /> following: mill building; storage sheds and tanks in which designated chemicals are <br /> stored or utilized; tailings facilities; and augmentation pond and its associated <br /> pipeline and discharge structure. <br /> 7. The Operator may not commence mining and milling activities until the <br /> Division receives and approves, through the Technical Revision or Amendment <br /> process, an updated Exhibit L and financial warranty addressing all applicable <br /> requirements of Rule 4, and specifically, but not limited to, Rule 4.2.1(4) regarding <br /> reclamation costs associated with the protection of water resources, including costs to <br /> cover necessary water quality protection, treatment and monitoring as required by <br /> permit, and the Act and Rules. The existing Exhibit L, submitted by the Operator, <br /> does not address this issue and is not adequate for approval. <br /> 8. Nothing herein shall be construed as any predetermination by the <br /> Division or the Board regarding any Technical Revision or Amendment required in <br /> this Order. <br /> DONE AND ORDERED this day of December 2011. <br /> FOR THE COLORADO MINED LAND <br /> RECLAMATION BOARD <br /> Barbara Green, Chai <br /> NOTICE OF APPEAL RIGHTS <br /> This order becomes effective and final upon mailing.
