Compliance With Mine Plan <br />N - Support Facilities Not On-site <br />NA -Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />N - Topsoil <br />COMMENTS <br />This was a special focus oversight inspection conducted by Janet Binns of CDRMS, Christine Belka and Jeremy <br />Iliff of the Office of Surface Mining -Denver Field Division, and Scott Cowman of Seneca Coal Company. The <br />Special Focus topic is protection of historic and cultural resources.The OSM and DRMS representatives had met <br />previously on 10/30/2015 at the DRMS Denver office to review records and determine which identified Historic <br />and Cultural sites were to be visited in the field. <br />The weather was raining and lightly snowing in the morning, making for wet, and muddy access roads. Once the <br />inspection commenced to the Yoast property the precipitation had stopped and the clouds were moving out. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The inspection began at the Foidel Creek Mine office with Scott Cowman, to review records. We were <br />unable to locate a follow up letter to the Metcalf Archeological Consultants report dated 5/31/2015, so records <br />were checked in the Peabody Sage Creek Mine office with no success. <br />Upon return to the office, on 11/5/2015, OSM representative, Jeremy Iliff, located a letter from the BLM, with <br />SHPO concurrence, dated 8/15/2994. This letter confirms that sites 5RT867 and 5RT871 were not eligible for <br />listing on the National Historic Register. This letter resolves the question of site eligibility that we had in the field. <br />GENERAL MINE PLAN COMPLIANCE: <br />During initial permitting of the Yoast Mine in 1994, the historic and cultural resources survey identified 7 <br />prehistoric sites, 2 historic sites and 9 isolated finds. Site 5RT865 was recommended for additional evaluation. <br />BLM & SHPO concurred that none of the identified sites were eligible for listing on the National Historic <br />Register. <br />The Inspection progressed down the Yoast access road to the identified location of 5RT871.
