Box 1974 <br />Idaho Springs, CO 80452 <br />RE: Hukill Gulch Millsite; DRMS File No. M-2009-076; Outstanding Corrective Action <br />Dear Mr. Maher, <br />The Division of Reclamation, Mining and Safety (Division) conducted an inspection of the above <br />referenced site on September 17, 2015. Following the inspection, the Division cited a problem for placing <br />waste rock onto the tailing impoundment liner. The Operator was required to submit a Technical Revision <br />to address the placement of waste rock onto the liner. The Technical Revision was to be submitted on or <br />before November 8, 2015. On October 29, 2015, the Division received a Technical Revision application <br />addressing the Weed Control Plan for the site. The Technical Revision did not directly address the tailing <br />impoundment liner, but rather stated that a plan of action would be submitted to the Division on or before <br />June 30, 2016. <br />The Division is not willing to grant an extension to June 30, 2016 to address the potentially compromised <br />liner. The tailing impoundment liner is an Environmental Protection Facility under the 110d Reclamation <br />Permit and was specifically designed to prevent the release of acid forming materials. Therefore, this <br />matter must be addressed immediately. The Technical Revision must be submitted to the Division on or <br />before November 30, 2015 and shall address the placement of the waste rock onto the composite liner and <br />provide a plan for determining if the liner has been compromised, a plan for removing the waste rock <br />from the liner and/or an engineering analysis to determine if the waste rock can be left in place while still <br />adhering to the approved design criteria. Failure to submit the Technical Revision by the corrective action <br />date may result in the Division pursuing enforcement actions before the Mined Land Reclamation Board. <br />If you have any questions, please contact me at (303)866-3567 x8116. <br />Sincerely, <br />Michael A.
