Revolted Pei -mit 46 (SL -01), DRMS <br />Proposed Decision and Findings Dated October 15, 2015 <br />Dear Mr. Boulay, <br />This letter acknowledges the Office of Surface Mining Reclamation and Enforcement (OSMRE), Denver <br />Field Division's (DFD) receipt and review of the above Termination of Jurisdiction (TOJ) document <br />prepared by the Division of Reclamation Mining and Safety (DRMS) dated October 15, 2015. The <br />revoked permit for the Sunlight Mine encompasses 180 acres of which 7.31 acres were affected and 5.24 <br />acres were disturbed by underground coal mining activities and subsequently reclaimed. The surface and <br />mineral rights are privately owned. The Colorado Mined Land Reclamation Board revoked the permit due <br />to a pattern of violations, and the $11,800.00 bond was forfeited on April 22, 1987. <br />DRMS conducted the primary reclamation of the site in the summer of 1990 using finds acquired through <br />the forfeited performance bond. DRMS expended all available finding to complete the reclamation plan <br />for this site. Subsequently, adit collapses created safety hazards. DRMS was able to secure additional <br />funding to abate these hazards using state severance tax dollars. DRMS performed additional work in <br />1994, 1999, and 2003 using these severance tax finds. All reclamation work was coordinated by the <br />Colorado Inactive Mine Reclamation Program and was conducted by private contractors. <br />DRMS has monitored the reclamation at Sunlight for over ten years and conducted a final site inspection <br />on June 8, 2015. OSMRE and a landowner representative participated in this inspection. DRMS did not <br />receive any comments from landowners or the public regarding its proposed TOJ action. <br />This Termination of Jurisdiction applies to all portions of the Sunlight Mine permit revocation/bond <br />forfeiture site. OSMRE agrees with DRMS's decision to terminate jurisdiction at Sunlight and hereby <br />provides its concurrence with this action. <br />Thank you and your staff for coordinating this private mine termination of jurisdiction action through the <br />DFD.
