By order effective July 9, 2015, the Board granted the Operator's <br />request for an extension to September 23, 2015 to complete adequacy items. <br />6. On August 25, 2015, the Division received a letter from a consultant on <br />behalf of the Operator requesting a second extension, to October 23, 2015, to the <br />deadline to complete adequacy items. <br />7. The Division does not oppose the Operator's second request for an <br />extension. The Division agrees that additional time is needed to resolve the <br />adequacy items before the application can be approved. <br />CONCLUSIONS OF LAW <br />8. The Board has jurisdiction over this matter pursuant to the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br />Title 34, C.R.S. (2014). <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board <br />hereby GRANTS the Operator's request for a second extension to submit all <br />application materials, in an approvable form, to convert the existing 110(c) permit <br />to a 112c reclamation permit.
