EXHIBIT A <br />DESCRIPTION OF RESTRICTIVE AREA <br />A parcel of land lying in the SW 1/4 of the SE '/4 of Section 6, Township 6 North, Range 90 <br />West of the 6th Principal Meridian, Moffat County, Colorado, and being more particularly <br />described as follows: <br />Beginning at the S 1/4 Corner of Section 6, Township 6 North, Range 90 West of the 6th Principal <br />Meridian thence N 25°11'34" E 1,450.59 feet to the Point of Beginning thence along the <br />following courses; S 70°53'36" E 566.75 feet; thence S 19°06'24" W 726.25 feet to a point on <br />the centerline of the Yampa River, thence along the approximate centerline of the Yampa River <br />S 76°15'50" W 181.91 feet; thence S 79°44'30" W 43.59 feet; thence N 89°48'36" W 397.39 <br />feet; thence leaving said centerline of the Yampa River N 19°06'24" E 975.12 feet to the Point of <br />Beginning. <br />Deed Restriction Area contains approximately 11.3 acres. <br />Explanation of acreage difference: <br />The Proposed Mitigation Plan, submitted November 23, 2010 discusses a Deed Restrictive Area <br />for the Mitigation Site that encompasses 11.78 acres. This acreage was calculated based on a <br />property line that was obtained from the County Assessor's office. Elam has, since the original <br />submittal, obtained a survey of the Bunn Ranch Property. This survey more accurately defines <br />the southern boundary of the Elam/Bunn Ranch property than previously assumed. Most notably, <br />the southern boundary of the property and restrictive area follows the curved alignment of the <br />Yampa River. This correct alignment of the southern boundary accounts for the difference in <br />acreage. <br />WestWater Engineering APPENDIX B - 6 July 2012 <br />
