Once success criteria have been met and verified, a final report and settlement agreement <br />will submitted to the EPA and COE. <br />2. Any final site inspections will be scheduled through the EPA and COE as necessary. <br />B. COE confirmation <br />1. Upon final and satisfactory completion of all specifications outlined in this plan the COE <br />District Engineer and EPA Regional Administrator will sign and date the settlement <br />agreement releasing the site as being in compliance with the Findings of Violation Order <br />CWA-08-2010-0035. <br />IX. CONTINGENCY MEASURES <br />A. Initiating procedures <br />1. Contingency measures are an active part of monitoring, any indication of deviation or <br />undesired trends trigger immediate corrective measures, i.e., weeds, undesired species, <br />unexpected alterations in hydrology. <br />B. Alternative locations for contingency mitigation <br />1. In the event the site demonstrates that it is incapable of sustaining the proposed <br />mitigation plan anytime during construction, a process of reevaluation of the alternatives <br />described in IV.1.b will begin and the most suitable site will be selected. <br />C. Funding mechanism <br />The Bunn Ranch Pit near Craig, Colorado is a sand and gravel pit permitted by the State <br />of Colorado DRMS, formerly the Mined Land Reclamation Division of the Department of <br />Natural Resources. The Bunn Ranch Pit was issued Permit Number M-1980-131 on <br />December 15, 1980. <br />The DRMS requires that all permit holders post a financial warranty, naming the DRMS <br />as the insured, in an amount sufficient to reclaim the operation should the operator default <br />in their obligation. These financial warranties must remain current for the life of the <br />permit. The current financial warranty for the Bunn Ranch Pit is $158,355.00 <br />WestWater Engineering Page 20 of 24 July 2012 <br />
