As you know, there is a DRMS permit overlap related to <br />the old Flatiron and Lafarge Greeley West Pit permit (M-1977-081) and the 25th Avenue <br />Site (M-2002-020) permit. The Greeley West Pit permit was transferred to the City of Greeley <br />in 2012, so the City currently owns both permits. It is my understanding that you and Mike Hart <br />(Hart Environmental) recently discussed the Cottonwood Land and Farms, LLC (Cottonwood) <br />desire to maintain the portion of the Greeley West Pit permit on the land generally north of the <br />Cache la Poudre River and owned by Cottonwood. <br />In order to facilitate Cottonwood's desire, the City has prepared the enclosed "Request for a <br />Partial Release of Permit Area" for the Greeley West Pit permit (M-1971-081). Currently, the <br />permitted area is 203.13 acres, as described in the Response to Completeness Comments letter <br />prepared by Blue Earth (March 16, 2012) during the 25th Avenue Site amendment application <br />process in 2012. From that area, the City is requesting a release of 164.64 acres leaving <br />only 38.49 acres permitted under M-1977-081 (see attached exhibits). <br />The owners of the properties to be released are: <br />City of Greeley <br />1100 10th Street, Suite 300 <br />Greeley, Colorado 80631 <br />(970) 350-9811 <br />Cottonwood Land and Farms, LLC <br />P.O. Box 229 <br />Boulder, Colorado 80306 <br />(303) 449-1441 <br />In addition to this letter, a "Request for a Partial Release of Permit Area" is concurrently being <br />submitted for the 25th Avenue Site permit (M-2002-020). That release request is intended to <br />remove the 25th Avenue Site permit from the parcel of land that is mainly north of the Cache la <br />Poudre River (38.25 acres) and an additional parcel of land in the southeast corner of the site <br />(38.16 acres) also owned by Cottonwood. Therefore, following release from the 25th Avenue <br />Site permit, the 38.25 acre parcel primarily north of the river will still be under reclamation <br />responsibilities of the Greeley West Pit permit. The release request for the 38.16 acre parcel in <br />the southeast corner of the site, however, is for final release since it is intended to be removed <br />from both permits. <br />Blue Earth Solutions, LLC • P.O.
