State PROOF OF PUBLICATION Notice of Proposed Decision The Colorado Division of Reclama- tion, Mining and Safety has issued a proposed decision to partially ap- prove Bond Release Application No. 8 (SL -8) for the Roadside Portals, Permit No. C-1981-041. This applica- tion is a request for release of Phase I, II, and III bond liability on both disturbed and undisturbed acres located within the permit boundary at the Roadside North and South Portals Mine. The following acreages are being proposed for re- lease: Phase I: 22.2 acres; Phase II: 136.5 acres; Phase III: 128.0 acres; undisturbed acres overlying under- ground workings: 744.0 acres; and unaffected acres: 1288.9. Total Dis- turbed acres to be released will be 128.0 acres. Total Affected acres to be released will be 872.0 acres. The Division is proposing a release of re- clamation liability in the amount of $663,429.00. Snowcap Coal Compa- ny has agreed to not request return of any bond monies associated with this approved reduction in reclama- tion liability until such time as is- sues related to potential hydrologic communication are resolved. The underground operation is operated by Snowcap Coal Company, Inc un- der the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release appli- cation was submitted by Snowcap Coal Company, Inc on September 4, 2013. The affected area is located in Mesa County, approximately 5 miles North of Palisade, Colorado. Any person who has an interest which is or may be adversely affec- ted may request an adjudicatory hearing regarding this proposed de- cision. Requests for a hearing must be made in writing within thirty (30) days of the first publication of this notice, and shall state with reason- able specificity the reasons for the request and objections to the pro- posed decision.
