I. Introduction <br />This document presents the proposed decision of the Colorado Division of Reclamation Mining and <br />Safety (Division) for the SL -01 Termination of Jurisdiction (TOJ) at the Sunlight Mine, Revoked <br />Permit Number C-1981-046. The Sunlight Mine is a permit revocation/bond forfeiture site. The <br />permittee at the time of permit revocation and bond forfeiture was Garfield Energy Corporation <br />(GEC). The permit area under consideration for termination of jurisdiction consists of 180 acres. <br />All of the surface acreage is private property. This termination of jurisdiction process (SL -1) was <br />initiated by the Division following reclamation of the site, expiration of a ten-year liability period <br />and upon completion of vegetation sampling at the site. <br />The Division has followed the requirements for review, public notice and public participation as <br />required for a bond release application in accordance with the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining - Rule 3.03. Detailed information about the bond release <br />review process can be found in the Colorado Surface Coal Mining Reclamation Act, the Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining <br />(htlp://mining.state.co.us/SiteCollectionDocuments/CoalRegulations9l405.pdf) and the Guideline <br />Regarding Selected Coal Mine Bond Release Issues (April 18, 1995) <br />(htlp://mining. state.co.us/Programs/Coal/RulesRegs/Documents/BondReleaseGuidelines.pdf). <br />Detailed information about mining and reclamation operations at the Sunlight Mine can be found in <br />the permanent program mining and reclamation permit application (C-1981-046) and associated <br />records on file at the Division offices located at 1313 Sherman Street, Room 215, Denver, Colorado <br />80203 or online at htlp:Hdrmsweblink.state.co.us/drmsweblink/search.aspx?dbid=0. <br />Lands Included in the Termination of Jurisdiction <br />The Sunlight Coal Mine site is located south and west of Glenwood Springs, in southeastern <br />Garfield County, Colorado. It straddles Garfield County Road 117 approximately 11 miles from <br />Glenwood Springs (1 mile before reaching the Sunlight Ski Area). The site is located in portions of <br />Sections 28, 33 and 34, Township 7 South, Range 89 West. This region is depicted on the Cattle <br />Creek, Colorado USGS 7.5 -minute quadrangle topographic map. The surface and mineral rights are <br />privately owned. <br />Dollar Amount to be Released <br />The Sunlight Mine is a permit revocation/bond forfeiture site. The Division used all of the forfeited <br />bond money to complete reclamation activities at the Sunlight Mine. Since all the bond money was <br />spent on the reclamation of the site, no money will be returned to the operator as a result of this TOJ <br />process. <br />3 <br />
