Bowles <br />Environmental Protection Specialist <br />Division of Reclamation, Mining, and Safety <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Re: New Horizon North Mine (Permit No. C-2010-089), Technical Revision No. 11 (TR -11) Western Fuels - <br />Colorado, LLC (WTC) Responses to Midterm Review 1 (MT -1) (HC #67460) <br />Dear Mr. Bowles: <br />"Thank you for your recent correspondence dated September 28, 2015 (received by our office on October 2, <br />2015) regarding the above referenced technical revision. <br />As the proposed midterm review does not involve any new surface disturbance or modify the approved mining <br />and reclamation plan, it is our opinion that the undertaking has no potential to affect historic properties. <br />Please remember that the consultation process does involve other consulting parties such as local governments <br />and Tribes, which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional <br />information provided by the local government, Tribes or other consulting parties may cause our office to re- <br />evaluate our comments and recommendations. <br />If previously unidentified archaeological resources are discovered in the course of the project, work must be <br />interrupted until the resources are properly evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
