RULE 2 PERMITS <br />Western Fuels — Colorado, a Limited Liabiliyt Company (WFC), is the permit applicant and mine <br />operator for the Colowyo Mine ( Colowyo). The general office is located at 5731 State Highway 13, <br />Meeker, Colorado 81641; telephone number (970) 824 -1200. Colowyo's Employer Identification <br />Number is 87- 0522903. Colowyo's Mine Safety and Health Adminstration (MSHA) identification <br />number is 05 -02962 and it was issued on October 1, 1976. <br />The duly Authorized Representative for WFC is Barbara Walz, Chief Compliance Officer for Tri -State <br />Generation and Transmission Association, Inc. The resident agent for WFC is Ken Reif, Senior Vice <br />President, General Counsel, 110 W. 116`h Avenue, Westminster, CO 80234, (303) 254 -3184. <br />Colowyo Coal Company L.P. will remit all required AML fees. <br />The current officers and directors of Colowyo Coal Company L.P., Western Fuels — Colorado, Western <br />Fuels Association, Inc. and Tri-State Generation and Transmission Association are included in Exhibit 2, <br />Volume 2A. <br />The legal or equitable owners of record of the property to be mined or affected by surface operations and <br />facilities incidental thereto are: <br />Colowyo Coal Company L.P., 5731 State Highway 13, Meeker, CO 81641 <br />State of Colorado, 1313 Sherman Street, Room 620, Denver, CO, 80203, <br />Bureau of Land Management, 455 Emerson Street, Craig, CO, 81625, <br />The legal or equitable owner of record of the coal to be mined is the United States of America, the State <br />of Colorado, and Guy and Holmes Shefstead, P.O. box 608, Craig, Colo. 81626 <br />Colowyo is the holder of Federal Coal Leases No. D- 034365, C- 35874, C- 29224, C- 29225, C- 29226, C- <br />0123475, C- 0123476, COC- 68590. Colowyo is also the holder of State of Colorado Coal Lease 257 -13S. <br />The surface and mineral ownership in the permit and adjacent areas is graphically shown on the Surface <br />Ownership Map (Map 1) and the Coal Ownership Map (Map 2) and the information found in Exhibit 1, <br />Documents and Leases. <br />Colowyo is the only holder of record of any leasehold interest in the property to be mined or to be <br />affected by surface operations and facilities incidental thereto. There are no other holders of record of <br />any leasehold interests for areas located within the property boundary. <br />There is no pending purchaser of record of any surface or mineral estate under a real estate contract for <br />areas located within the permit boundary. <br />Information regarding the internal Permit area and contiguous surface and subsurface ownership may be <br />found in Exhibit 1, Item 11. <br />2.03.5 Compliance Information <br />None of Colowyo, any subsidiary, affiliate, or persons controlled by or under common control with <br />Colowyo has: (a) had a federal or state mining permit for surface coal mining operations suspended or <br />revoked in the five years previous to the date of this application; or (b) forfeited a mining bond or similar <br />security deposited in lieu of bond. <br />Rule 2 Permits 2.03 -6 Revision Date: 12/30/14 <br />Revision No.: MR -138 <br />
