properties in this area adjacent to the east side of the South Platte River and west side of US -85), therefore, any <br />kind of residential or commercial development of this property (including well and septic and below -grade <br />basement level structures) would in all likelihood be prohibited. There are two abandoned homes on the <br />property. Aurora specifically bought this property for the express purpose of a future well -field adjacent to the <br />river for the Prairie Waters project and will convey water by a piping it across the WCR-8 bridge over the South <br />Platte River to the west. This property is upgradient from the Chavers site and is also in the groundwater <br />shadow of the Lupton Lakes operation (described above), except for immediately adjacent to the river where the <br />well -field will be developed. ASCI has had discussions with Aurora about the future of this area for this type of <br />development, including on the Chavers property. <br />Michael Bradley Horse Property.�_Adjacent to the north side of the Chavers Mining Resource site is this <br />approximately 30 -acre property. More than half of this property is located within the FEMA defined 100 -year <br />floodway and the remainder is within the floodplain. There are no permanent residential structures on the site <br />and no registered well. The property is used exclusively for horse pasturing. Access to the site is by a <br />"grandfathered" unsafe access consisting of a dirt road off of southbound US -85. For the reasons cited with the <br />Aurora site, any residential or commercial development of this property would in all likelihood be prohibited. <br />Also, the river takes a sharp bend to the east just to north of this property and would supply a large amount of <br />alluvial groundwater for a well should that opportunity ever exist. "Shadowing" of the alluvial groundwater <br />directly attributable to the Chavers slurry -wall construction would not exist. <br />For the reasons cited above, ASCI feels that the issue of mounding and shadowing caused by slurry wall <br />construction on the Chavers Mining Resource site to man-made structures is effectively non-existent and <br />monitoring wells should not be required. <br />EXHIBIT H- Wildlife Information: We re -submitted information consisting of an explanation/photos of the <br />current conditions of the location of the proposed mining and reclamation and relation to riparian habitat <br />(PMJM habitat) to the USFWS beginning on October 7, 2015. Their most recent response is contained with the <br />enclosures as part of this adequacy response. I will forward the extended/new clearance letter to you from the <br />USFWS later this week. <br />EXHIBIT L -Reclamation Costs: ASCI has considered the two options for bonding of the slurry wall <br />construction and has decided that accepting the option for no exposure of groundwater on the site until SEO <br />approval is obtained that the slurry wall does not "leak" is preferable. Therefore, ASCI commits to not <br />exposing groundwater at the Chavers Mining Resource site until SEO approval is obtained for the proper <br />functioning of the slurry wall surrounding the pit area. <br />EXHIBIT M -Other Permit and Licenses: The Flood Hazard Development Permit to be obtained from the City <br />of Ft. Lupton is part of the Special Use Permit process from the City. Please see enclosed materials requiring <br />that this permit be obtained prior to commencing operations at the site. <br />EXHIBIT S -Permanent Man -Made Structures: ASCI will obtain permission from all structure owners listed in <br />this exhibit as part of the application materials before mining commences within 200 ft. of any structure and <br />will supply the DRMS with the structure agreement to be placed within the permit file. This action was started <br />in 2008 and the enclosed responses were obtained. ASCI will update and will fonnally obtain an agreement <br />with these and the other entities. If an agreement cannot be reached, ASCI will perform a geotechnical study <br />that will demonstrate that no damage will occur to the structure and will forward this study to the DRMS for the <br />permit file. Ft. Lupton has annexed Weld County Rd. 8 adjacent to the southern permit boundary and therefore <br />has given approval for mining within 200 ft. of this road by a defacto approval. A Surface Use Agreement was <br />put into place with Anadarko Petroleum for the two oil/gas wells on the site and a copy of that agreement <br />should be on file with the DRMS. <br />
