Vince Massarotti of New Elk Coal Company (NECC) accompanied the inspection. The weather was
clear, and the ground was dry.
Rob Zuber discussed with NECC staff (Vince and Louis Head) the idea of discussing the erosion problem (see
below) with the landowner of the Golden Eagle property. If the landowner believes that the problem is
inconsequential, a letter would from this person(s) could help smooth the anticipated bond release process.
HYDROLOGIC BALANCE - Rule 4.05
Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10;
Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13;
Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18:
An erosion problem at the northwest corner of the site was observed. This problem has been discussed in
past inspection reports and is mostly the result of poor stormwater management and the resulting runoff from the
adjacent, upgradient property. Straw bales are in place to limit the damage of this erosion, but these BMPs are in
need of repair.
Number of Partial Inspection this Fiscal Year: 2
Number of Complete Inspections this Fiscal Year: I
Page 2 of 4
