Brock Bowls, DRMS
Page 3
October 14, 2015
4.) For the disturbances planned within the stream buffer zones, the operator should add a discussion to
section 2.05.6(3) of the permit on how they will comply with the performance standards outlined in
Rule 4.05.18(1)(a)(b) and (c).
a. Tristate response: A description has been included in section 4.05.18 describing how the
disturbances planned within the stream buffer zones will comply with the performance
standards outlined in Rule 4.05.18.
b. DRMS response: This description is not included in revised section 4.05.18. This item
remains outstanding. See item number 1 above for more details.
5.) A Corps of Engineers 404 permit needs to be obtained prior to disturbing stream crossings and
wetlands within the permit area which are located within the stream buffer zones. WFC is
proposing to disturb areas within stream buffer zones and it is unclear if a 404 permit has been
obtained. Please submit a copy of the 404 permit for inclusion into the permit and update Section
2.05.6(3) and 2.03. 10 accordingly.
a. Tristate response: A copy of the approved Nationwide General Permit No. 21 — Surface
Coal Mining Activities (Section 404) from the U.S. Army Corp of Engineers is on file at the
New Horizon Mine Office and available for review at the Division's request. Also, Section
2.03.10, 2.05.4(2), 2.05.5, 2.05.6(2), and 2.05.6(3) which reference the 404 permit have
been updated accordingly.
b. Division response: Item resolved.
