DRMS response: This description is not included in revised section 4.05.18. This item <br />remains outstanding. See item number 1 above for more details. <br />5.) A Corps of Engineers 404 permit needs to be obtained prior to disturbing stream crossings and <br />wetlands within the permit area which are located within the stream buffer zones. WFC is <br />proposing to disturb areas within stream buffer zones and it is unclear if a 404 permit has been <br />obtained. Please submit a copy of the 404 permit for inclusion into the permit and update Section <br />2.05.6(3) and 2.03. 10 accordingly. <br />a. Tristate response: A copy of the approved Nationwide General Permit No. 21 — Surface <br />Coal Mining Activities (Section 404) from the U.S. Army Corp of Engineers is on file at the <br />New Horizon Mine Office and available for review at the Division's request. Also, Section <br />2.03.10, 2.05.4(2), 2.05.5, 2.05.6(2), and 2.05.6(3) which reference the 404 permit have <br />been updated accordingly. <br />b. Division response: Item resolved. <br />
