Rationale for Recommendation to Approve <br />Page 15 <br />October 5, 2015 <br />On April 14, 2015, the Division provided notice of the permit application to History Colorado. <br />History Colorado has not indicated there are any cultural resources within the proposed mine <br />site. <br />7. Concerns regarding release of water from proposed sediment ponds. (Schmidt) <br />Pursuant to Rule 3.1.6(1)(b), the application must demonstrate compliance with applicable <br />federal and Colorado water quality laws and regulations, including statewide water quality <br />standards and site-specific classifications and standards adopted by the Water Quality Control <br />Commission. <br />On April 14, 2015, the Division provided notice of the permit application to the Water Quality <br />Control Division of the Colorado Department of Public Health and Environment. The Colorado <br />Division of Water Resources has not indicated any additional permits would be required for the <br />mining operation. Therefore, the Office determined the application is in compliance with the <br />requirements of Rule 3.1.6(1)(b). <br />There will be no discharge of process or storm water from the mining operation. The proposed <br />sediment ponds will be located outside of the 100 year floodplain and will not be hydraulically <br />connected to the Middle Fork of the South Platte River (River). The sediment ponds will be <br />incised in undisturbed ground; no dam or impoundment will be constructed to hold process water <br />above the ground surface. Water levels within the sediment ponds will be monitored and a one <br />foot freeboard will be maintained so that water levels do not exceed the top of the sediment <br />pond. No chemicals will be used in the washing of placer deposits. <br />Conclusion <br />Therefore, on October 5, 2015, the Office determined the application satisfied the requirements <br />of Section 34-32-115(4) C.R.S., and issued its recommendation to approve the Hard Rock 112 <br />application for the Sullivan Aggregate Pit, File No. M-2015-017. <br />
