The Division is required to make <br />an approval or denial decision no later than October 31, 2015 therefore; a response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. <br />The Division requests the Applicant submits updated exhibits with a revision date in response to <br />this adequacy letter instead a full copy of the amendment application package. <br />Item #1 from the May 19, 2015 adequacy letter was addressed satisfactorily by the Applicant. <br />2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of <br />surface and mineral rights of the affected land and the owners of record of all land surface <br />within 200 feet of the boundary of the affected land including all easement holders located on <br />the affected land and within 200 feet of the boundary of the affected land. Proof of notice may <br />be return receipts of a Certified Mailing or by proof of personal service. <br />The Applicant stated they submitted proof of notice to all landowners within two hundred <br />feet of the amended area. The amendment application proposes to change the post mining <br />land use from wildlife habitat to developed water resource, therefore the Applicant is <br />required to notice all landowners within 200 feet to the Loloff Mine, not just the <br />amendment areas. <br />The notice must specify the proposed change in post mining land use to developed water <br />resource.
