Box 1430 <br />Palisade, Colorado 81326 v+�Joe <br />Re: Access Road Reclamation <br />Drilling Exploration, Plan <br />Coal Lease COC -029889 <br />ELM Access Road Right -of -Way (R/W) <br />Dear Mr Reschke: <br />This letter is a result of the joint inspection with Dave Trappett and Bruce <br />Fowler of my staff, and yourself on September 3, 1997. The inspection <br />-\ included throe access roads to drill holes identified as PCC -01 through PCC -10 <br />l) <br />in your 1984 and 1985 drilling exploration plan. <br />The first access road inspected, accessed drill holes PCC -06 through PCC -10. <br />The inspection and additional review of records revealed that the road in <br />question was utilized for fire control by ELM after you had completed <br />reclamation. In addition, BLN management of this access has changed since we <br />first required you to reclaim Che road. This access has been identified for <br />use in the Grand Mesa Slopes recreation plan and therefore we do not want any <br />additional reclamation completed on this access. <br />The second access road inspected, accessed drill holes PCC -04 and PCC-05.According to our letter of October 25, 1985 (enclosed), the reclamation <br />requirements for this road was to install waterbars and to seed it. This work <br />has been completed. Vegetatio_-n has beers established and additional <br />reclamation would be counter productive as it would cause additional <br />unnecessary erosion. BLM does not want.any additional disturbance to occur on <br />this reclaimed area. <br />The third access road inspected, accessed drill holes PCC -01 through PCC -03. <br />This road has been reclaimed to the requirements of the approved plan. <br />Specifically, ELM requested that the portion of the access =oad south and west <br />of the south portals be left in glace and rot recon=oured from the south <br />portals to near the top of the dugway in Lot S, Section 11, T. 11 S., R.98 W_ <br />P This was requested to facilitate livestock management. Therefore, the BLX <br />does not want any additional reclamation completed an this access road. <br />In addition., a portion of the access road to drill holes PCC -06 through PCC -10 <br />traversed a portion of ELM surface that was off of your lease and Colorado <br />State pe_^..ut a=ea. BXX R/W CC -C-40248, which pormitted your use o= this <br />portion of the road, expired on Jure 6, 1986. This letter serves as a release <br />of your liability to the ELM for reclamation on the above ide_=i=led access <br />roads (on and off lease) as well as the drill holes. If in the suture, you <br />have the need to use any off -lease road on BLIM surface, bevard that use <br />J - 1 <br />
