Boulay <br />Division of Reclamation, Mining 8t Safety <br />Department of Natural Resources <br />101 South 3rd, Suite 101 <br />Grand Junction, CO 81501 REC 'LE IVE Q <br />Re: Roadside Portals Mine (Permit No. C-1981-641) MAR Z 14 <br />Objection Letter to Bond Release Application SL -8 <br />Dear Mr. Boulay: <br />I have additional data/concerns regarding the statements in the objection letter <br />that I would like to provide while you are conducting your review of the SL -8 surety <br />release application. <br />I have documentation confirming that I was paid to remediate subsidence features. <br />While subsidence features routinely occur in area where underground mining occurs, the <br />change in this specific hydrology makes irrigation very difficult/wasteful. I've also <br />found that there may be documentation of parcels in the area being restricted as "unbuild- <br />able" because of the subsidence features. (I am trying to get copies of this <br />documentation.) This has a direct monetary affect on land owners. I will plan to take <br />baseline readings at the water discharge meter from the mine, and monitor output changes <br />as I attempt to irrigate my land in the 2W and 3W area. Again, subsidence is not <br />uncommon, but this dramatic change in hydrology is not acceptable or normal. <br />I have concerns over the liability of the discharge from the mine. In the long <br />tern, who will be responsible for monitoring, filtering, cleaning, and/or remediating <br />further damage caused by an anticipated increase in discharge. Will the Division of <br />Reclamation, Mining, and Safety? Is this the domain of the Health Department? Again, <br />the current levels of output probably do not elicit concern, but the anticipated increase in <br />output due to agricultural irrigation will cause problems. <br />I appreciate your inclusion of this information in your review, and look forward to <br />getting these concerns resolved to everyone's satisfaction. <br />Sincerely, <br />.
